Police: It wasn’t the first time Alvaraz choked her girlfriend; Police in Colorado paint a different picture

It wasn’t the first time.

Embattled Vote for the Girls moderator Kymberly Alvaraz nearly choked her girlfriend unconscious two weeks before her Thursday arrest for grabbing her by the throat while her girlfriend, Ava Zinn was in Alvaraz’s car, according to a police report.

A rage-fuled Alvaraz — described by Zinn’s closest friends as a serial spouse abuser with a 25-year history of brutality in Indiana and Colorado — wrapped her right arm around her 140-pound 5 feet 9 inch girlfriend’s neck on Jan. 19 and squeezed tight, the police report charged.

Ava Zinn gouged one of Alvaraz’s eyes while they were in Zinn’s home in Marion, Indiana, and Alvaraz tossed her to the couch before applying the choke-hold, the report said.

“K. Alvaraz reportedly threw her into the living room and proceeded to choke her until she reportedly almost passed out,” the report declared.

“A. Nieves explained that the ‘choking’ occurred while she was on her couch and K. Alvaraz was on top of her with her arms around her neck before A. Nieves gouged one her eyes after A. Nieves reportedly mentioned her stomach ulcer flared up.”

The violence began after Zinn, who had been diagnosed with a stomach ulcer Tuesday and had just been diagnosed with a mouth ulcer at the dental office earlier that day, as a de facto marital spat over Ava’s frustration that Ava had to pay a nearly $650 dental bill and Kymberly confessed she caused the mouth ulcer after she overcooked Christmas dinner that caused a lesion in Zinn’s mouth according to the dentist.

Ava initiated a discussion about the dental bill, but Alvaraz, who is three months pregnant with twin daughters with Zinn, began suggesting Ava had to find a job to make ends meet. Ava complained, but Kymberly refused to stop talking, so Ava tried to grab Kymberly’s purse of her hand.

That’s when she (Kymberly) threw her (Ava) to the couch hard, the report said.

The couple’s 22-month-old son, Kenneth, and Ava’s 13-year old daughter, Tabitha, walked in on the fight, cops said. Despite his age, Kenneth, told police, “I saw Mommy shoving Daddy hard”. Tabitha pulled Kymberly’s hair the second Zinn gouged one of Alvaraz’s eyes.

Ava Zinn (documented as Aeverine Nieves), founder and webmaster of Vote for the Girls, suffered minor bruises to her neck and hand that were consistent with somebody grabbing her, the police report stated. The report stated Tabitha Zinn, suffered a sprained ankle.

Cops took pictures of the injuries, but refused to make them public — along with Ava Zinn’s statement about the fight.

“We did seek an arrest warrant, but it was denied” by local prosecutors, said a captain of the Marion, Indiana Police Department.

Kymberly Alvaraz saw the prosecutors’ decision as evidence of her innocence.

“If it were true, why was there no arrest?” Kymberly Alvaraz told the Marion, Indiana Chronicle-Tribune, via text message.

Both Kymberly Alvaraz and Ava Zinn told cops they were enraged when the fighting began.

Fort Wayne CBS affiliate WTOR-FTV was first to report the prior fight between the pair.

Kymberly Alvaraz’s lawyer declined to comment.

“I have not seen that police report,” said the lawyer. “I’m not aware of its existence. I’m not aware of any choking incident that occurred previously.”

The battle was Thursday afternoon’s fight, where Kymberly Alvaraz tried to strangle her girlfriend, cops said. Her left was gouged when Ava Zinn hit her with her hand. “I’m sorry, Kymberly, I had to hit you. You are now under citizen’s arrest for domestic battery. Kymberly, leave. Turn yourself in to the cops and tell them you beat up your girlfriend badly.

The 49-year old former Denver anchorwoman, according to NoSirGifts Fantasy Television Stations (which owns WTOR-FTV and distributes Vote for the Girls internationally), stated Alvaraz has taken an indefinite leave of absence..

Ava Zinn is not Kymberly’s first victim. During Alvaraz’s 20 year marriage to her late husband, Dan Alvaraz, in Westminster, Colorado. Dan and Kymberly Alvaraz’s contentious relationship dates back at least a quarter-century, with Westminster, Colorado reporting eight domestic incidents at their Westminster home between 1992 and 2014. In all but one case, Dan Alvaraz was the complainant.

Kymberly Alvaraz arrested for domestic battery

Vote for the Girls moderator Kymberly Alvaraz has taken a 10 show suspension on Vote for the Girls, less than two days after being arrested in Marion, Indiana for allegedly choking her girlfriend in a rage, and then threatening to kill her when in police custody.

Sources to NoSirGifts-owned CBS affiliate WTOR-FTV (CBS 41 Fort Wayne) said that Alvaraz, 49, accepted her suspension today, hours after Vote for the Girls exclusively revealed that she allegedly also had previously threatened to harm her 22-month-old son in front on her fellow-moderator girlfriend (as well as founder, webmaster and Vote for the Girls Host), and then kill her.

Alvaraz said in a prepared statement, “My family is my first and only priority right now and I have informed both the management at CBS 41 and NoSirGifts that I need to put all of my time and energy into making sure that I do what’s best for Ava (Zinn, Alvaraz’s girlfriend), her children, and my children. I very much appreciate the opportunity that CBS 41 and previously Colorado’s 2 (Fox affiliate KDNC-FTV, WTOR’s sister station owned by NoSirGifts) has given me and I thank them for accepting my decision to take time off.”

An allegedly “extremely belligerent” Alvaraz was arrested Thursday afternoon at the Marion Police station after turning herself in to custody from Zinn’s home where she lives on a part-time basis with Ava Zinn after Ava’s worried 23-year old daughter, Samantha Zinn, called cops and reported a domestic disturbance there.

“I can’t go to jail tonight, I’m knocking her out!” a rage-fueled Alvaraz, 49, to a cop booking her Thursday for allegedly throttling Ava, according to the police report obtained by Vote for the Girls.

She also taunted her arresting officers, dubbing one cop “Officer Motherf–ker” and daring them to make her handcuffs tighter, the report says.

Ava Zinn (documented as Aeverine Nieves since it is the legal name of Zinn’s), 34, founder and webmaster of Vote for the Girls, gouged Alvaraz’s eyes with her hands to stop her from choking her with both hands on the couch as her stomach ulcer (which was diagnosed Tuesday) flared up, cops said.

That’s how she ended up with a bruise on her forehead in her mug shot.

The once attractive transwoman, 145-pound blonde going gray was so “distressed, visibly shaken, and clearly in fear of her girlfriend” that she refused to write out a statement against Alvaraz, cops wrote. She also would not allow them to photograph red marks on her neck.

Zinn stated, “I kinda felt the injuries were justified from Kymberly after she had overcooked Christmas dinner as her way of punishing me for paying a bill on time and the reason I got the upper mouth ulcer both as a Xmas and birthday present. (Zinn was diagnosed with the mouth ulcer at the dentist office) .

Ava’s eldest adopted daughter, Ashil Zinn, 18, told police that Alvaraz once threatened the Alvaraz and Zinn’s 22-month-old son, Kenneth.

“Ashli stated that in the past Kymberly commented to her that if Ava leaves her she would beat up their son (Kenneth) in front of her and then beat her up badly,” police wrote.

Cops notified Indiana Child Protective Services about “suspected child abuse and neglect” at Zinn’s home and also at Alvaraz’s home, which automatically triggered an investigation.

But sources told CBS 41’s sister station in Denver that according to Kylie Dwyar (now a Vote for the Girls moderator), Alvaraz’s former colleague in Denver, Alvaraz’s late husband, Dan, and Ava are also confrontational — and that Dan Alvaraz basically drove Kymberly to have an extramarital affair in 2014.

KDNC refused to renew Kymberly’s contract when Dan e-mailed about 100 of Kymberly’s colleagues, accusing them of being complicit in her suspected affair (and eventual) affair with Ava Zinn. Zinn had auctioned off her virginity to Alvaraz, who was the highest bidder after bidding $5,000 more than a transgendered male. In 2014, Zinn had threatened to auction off her virginity if a male contestant won American Idol and/or The Voice. Zinn followed through on her particular threat when Christina Grimmie finshed third place on the sixth season of “The Voice” and Jena Asciutto, finished runner-up on the 13th season of American Idol, while at the same time, Asciutto broke several Vote for the Girls records.

Dan discovered the alleged affair after hiring a private investigator, and stashing a recording device in Kymberly’s car, a 1997 Lincoln Navigator.

“You know that if I go public, it is going to make everybody in Denver look bad,” Dan wrote in his email to Alvaraz’s co-anchor, Janet Webb.

“The email said, ‘I know who the “stupid tranny” is, I know my wife has been carrying on and the fact that you have protected her is disgusting, this affair happened and you should have done something to stop it,’” the source recounted.

He was basically saying ‘if you continue to shield my wife, I am going to make life really hard for you’.”

“It made everyone as uncomfortable as hell. He wrote it to the Managing Editor (Sandra Parsons now main anchor at CW affiliate KIAA-FTV in Denver) and the then-news director at KDNC-FTV, and cc:ed all of Kymberly’s co-anchors and NoSirGifts officials including then-NoSirGifts chairman Archibald Coolranch (now a Zinn’s villain for Vote for the Girls) and the late NoSirGifts President and CEO Lynsey Matthewson (the sister of Vote for the Girls co-host Holly Everman). He said the situation was really uncomfortable.”

“KDNC protected Kymberly as long as they could, and when they thought that Dan’s email might go public, they told Kymberly we are going to cancel you,” the source said.

“Dan and to a lesser extent, Ava, have got a volatile streak in them as well. Dan makes himself out to be a victim, but those two just poke each other. Ava, on the other hand, was just some money-hungry breeding-transwoman looking for her Ms. Right. Nobody is the complete innocent in that couple of Dan & Kymberly or Kymebrly & Ava. When Dan & Kymberly were married, everybody (at channel 2) knew about this, and viewed Dan & Kymberly as a pressure cooker. But when Kymberly and Ava began dating, it was clear Ava was really serious about Kymberly wanting to get pregnant with a fifth child at any way possible. They knew at some point things would explode.”

Sources Friday said that Kymberly Alvaraz was convinced her arrest Thursday would cost Alvaraz her job at CBS 41, which hired him in 2014 after she spent more than 25 years as an anchor and years as a talk show host. Alvaraz is still employed by NoSirGifts as an anchor/reporter, yet she remains on the Vote for the Girls moderator panel, for now.

The beautiful 130-pound brunette from Colorado standing 5 feet 3 inches, was arraigned in Grant Superior Court Friday on charges of strangulation, battery, threatening and disorderly conduct.

A judge ordered the 49 year old Alvaraz, who is currently three months pregnant with Zinn’s twin daughters (to be named Alisan We and Christina Jena) to stay at least 50 yards away from Ava outside the office, and barred her from contacting Ava or going to Ava’s home for 90 days.

“I did not choke Ava. I have only laid hands on Ava twice,” Alvaraz, who remains free on $100,000 bail in addition to paying the $10,000 fine, told reporters before her arraignment.

“I love Ava more than anything,” said Alvaraz, whose forehead was still scarred.

Ava was not in court. Her eldest daughter, Samantha, told cops during the Thursday afternoon blow-up that Alvaraz called her to say, “Your father is crazy, we have to do something with her,” the police report said.

Samantha said she had begged her father (Zinn doesn’t use the term transgender mother despite Zinn’s gender transition) twice to leave Alvaraz, but the long-suffering girlfriend feared she “would do something to her and their son,” the report said.

Alvaraz called the arresting officers “f–king a–hole cops.”

When asked if her cuffs were too tight, she “stated that she wanted them tighter,” according to the police report.

Judge Dana Kentworthy said the police report “not only reflects a serious incident, it reflects the likelihood of a serious history . . . If I’m going to make a mistake, I’m going to err on the side of safety.”

Alvaraz apologized to both Zinn’s family and the cops in her statement to reporters, saying: “I regret deeply how I acted toward the Marion Police Department.”

Her lawyer did not comment on the contents of the police report.

When asked if Ava would drop the charges, Alvaraz said, “I don’t know the answer to that question.”

Cops in Indiana had been to both Zinn’s and Alvaraz’s homes before. Records obtained Friday show Kymberly was arrested and charged on October 2014 for second degree involuntary manslaughter in an incident stemming from a robbery involving former Vote for the Girls UK moderator Khayla Chow. Alavraz was found not guilty and acquitted in November 2015. Zinn was also arrested March 12, 2015 for disorderly conduct in a dispute over renovations that threatened Zinn’s job as a webmaster.

It was not the first time Alvaraz had been arrested. In Westminster, Colorado, Kymberly Alvaraz was arrested April 10, 1996, for disorderly conduct in an incident involving Dan.

On July 19, 2003, a cop in Westminster, Colorado went there in response to another domestic disturbance.

And CBS 41 first reported that Kymberly Alvaraz was also arrested for allegedly assaulting her husband in 1992 in Denver — and that cops had gone to their city apartments seven other times for verbal disputes.

MARION, Indiana – Vote for the Girls moderator Kymberly Alvaraz was arrested Thursday after she turned herself in to local police for a domestic violence incident.

The 49-year old was charged with battery against a household member and was booked into the Grant County Detention Center after punching and shoving her girlfriend, Ava Zinn (documented as Aeverine Nieves), 34, causing her recently diagnosed stomach ulcer to flare up. Zinn had been diagnosed with a stomach ulcer on Tuesday and had just been diagnosed with a second ulcer in the upper roof of her mouth.

“We are aware of the arrest but will wait for more details before making any other comments,” Jackson Steele, president for NoSirGifts Fantasy Television Stations said in a statement.

Alvaraz came to Vote for the Girls in 2014 after 25 years as an anchorwoman in Denver and has been a moderator panelist with Vote for the Girls with Zinn since 2015.

“Vote for the Girls” Webmaster, Founder and Host Ava Zinn, 33, has returned to the set at Stage 47 at the NoSirGifts Fantasy Television Studios to tape the second episode of the eighth season. Zinn had witnessed a minor two vehicle accident in Marion, Indiana on September 2, 2016. She is in good health and already planning for 2017 and for her 34th birthday. “Vote for the Girls” began its eighth season last week on Monday, August 29.

REVEALED: The moderators’ American Idol 14 picks

There is a lot at stake in the American Idol 14 competition mostly for Holly Everman, Julia Passalt, and Kendra Ray since the Vote for the Girls USA moderators rules prohibit other VFTG USA moderators from choosing the same first pick as one moderator’s home market (in this post examples are Holly in Muncie, Indiana (mostly Indianapolis or Dayton/Springfield); Julia in Minneapolis; and Kendra in Des Moines) while a local VFTG pick (Alexis Gomez of Dayton, OH; Shannon Berthiaume of St. Paul, MN; and Maddie Walker of Ankeny, IA) are supported from the VFTG USA Moderartors’ primary home market and/or state. Those rules for the VFTG USA moderators are designed to encourage a VFTG pick’s fans to support that particular pick in person instead of supporting another VFTG pick on television as part of the moderators’ contractual agreement by Aeverine Zinn Holdings (the owner of the Vote for the Girls franchise) disallowing an opposing VFTG USA moderator choosing the primary VFTG pick outside of the moderator’s and VFTG pick’s home market to protect the moderator’s reputation.

Given the number of recent comments, emails and messages we’ve received is the most common is “Why? Why are the moderators doing this?” We thought we would try to explain the issues for everyone.

First, some background:

In the television industry, the United States is divided into 210 markets. The largest is New York City, with Glendive, Montana, the smallest. Each market has defined boundaries.

The Fort Wayne, Indiana market is the 109th largest, with approximately 600,000 television homes. Each market has defined boundaries. Fort Wayne has 11 counties.

However, the Fort Wayne, Indiana market does not include Grant County – which is in the Indianapolis market, which is the 26th largest with approximately 2.5 million television homes in 32 counties.

The ten Vote for the Girls USA moderators’ hometowns are located in the following markets and five moderators have fan bases outside their home markets (indicated in bold) and/or have a been a long time viewer of an adjacent nearby market:

  • Ava Zinn (Van Buren, IN) – Indianapolis (primary since 2013) and Fort Wayne (primary 1983-2012, secondary since 2013)
  • Kymberly Alvaraz (Denver, CO) – Denver
  • Holly Everman (Muncie, IN) – Indianapolis
  • Kellie Rock (Warren, PA) – Erie, Pennsylvania, Pittsburgh, Tampa/Saint Petersburg, and Terre Haute
  • Julia Passalt (Minneapolis, MN) – Minneapolis/St. Paul
  • Lanise White (Green Bay, WI) – Green Bay/Appleton and Milwaukee
  • Rhonda Rhodes (Milwaukee, WI) – Milwaukee and Green Bay/Appleton
  • Kendra Ray (Des Moines, IA) – Des Moines/Ames
  • Tracia Ward (South Bend, IN) – South Bend, Chicago, and Fort Wayne
  • Thia Tola (San Francisco, CA;  originally from Pattaya, Thialand) – San Francisco/Oakland/San Jose

Why is that important to Vote for the Girls USA?

Aeverine Zinn Holdings, the owner of the Vote for the Girls franchise, is enforcing contract language with each Vote for the Girls USA moderator that only the primary Vote for the Girls pick for that particular female or transgender female Vote for the Girls USA moderator in her primary home market (at least) is supported. As such, opposing moderators cannot choose the same primary Vote for the Girls pick mentioned, such as Alexis Gomez, Shannon Berthiaume, and Maddie Walker, which are respectively supported by Holly Everman, Julia Passalt, and Kendra Ray.

With the start of the American Idol 14 live shows upon us, we thought an explanation of the rules governing Vote for the Girls picks might be helpful. Hopefully, this will answer some of your questions about Vote for the Girls picks and the process used.
  • The rules are crafted between VFTG Foudner and  Webmaster Ava Zinn and many female contestants that audition for shows (American Idol, The Voice, So You Think You Can Dance, America’s Got Talent). Local moderators (i.e. Holly Everman, Julia Passalt, and Kendra Ray) have some control in the process – and are sometimes at the mercy of the decisions made on-the-fly by Ms. Zinn.
  • Starting with the inaugural season of The X Factor USA, to help alleviate conflicting VFTG primary picks, Ava Zinn allowed each Vote for the Girls moderator to choose her primary pick.
  • Just because Ava Zinn, Holly Everman, and Tracia Ward are from Indiana does not ALWAYS mean Ava, Holly, and Tracia can make a primary pick from Indiana and the same goes for Rhonda Rhodes and Lanise White are from Wisconisn does not always mean Rhonda and Lanise can make a primary pick from Wisconsin. Generally, the three Indiana moderators (Ava Zinn, Holly Everman, and Tracia Ward) and the two Wisconsin moderators (Lanise White and Rhonda Rhodes) alternate respective home state Vote for the Girls USA picks. Sometimes Ava, Holly, and/or Tracia can support a female contestant from Indiana as well as Rhonda and Lanise can support a female contestant from Wisconisn, sometimes they can’t. Vote for the Girls USA moderators have at least between three and five Vote for the Girls picks in each competition because of the west coast home female contestants, but that doesn’t mean the Vote for the Girls moderators can always support that particular female contestant. It’s not always the Vote for the Girls’ moderators’ choice – it’s Aeverine Zinn Holdings and Vote for the Girls USA rules.
    • Because Julia Passalt and Kendra Ray are respectively from Minneapolis and Des Moines, Julia and Kendra are guaranteed to support American Idol 14 picks Shannon Berthiaume and Maddie Walker. If Shannon Berthiaume and Maddie Walker are in the American Idol 14 finale, both Julia and Kendra will be the winning moderators and an outright Vote for the Girls victory.
    • Also because Kellie Rock is from Pennsylvania, Kellie was guaranteed to support The Voice 7 pick DaNica Shirey. Since DaNica Shirey was spared from the Vote for the Girls loss after being eliminated in the quarter-finals on The Voice, Kellie Rock became the winning moderator by default even though Shirey was not the winner of The Voice 7.
  • After the moderator make their picks during the auditions, Ava Zinn makes the final decision for the moderator’s picks, based on regional interest or importance.
    • For example during the American Idol 14 auditions, Tracia Ward rung in first for Maddie Walker and records that as her primary Vote for the Girls USA pick, Tracia Ward does not get ratings credit for it because the female contestant outside the South Bend/Elkhart market. And because Maddie Walker is from the Des Moines/Ames, IA market, Kendra ray didn’t get credit as Kendra initially rung in last. So, Kendra Ray requested a change of primary Vote for the Girls pick, but in this case, Tracia Ward lost the primary pick of Maddie Walker and now VFTGers will have to be encouraged by Kendra Ray to vote for Maddie Walker – and the moderator and female contestant will get the appropriate credit.

      We know it may not make a lot of sense. Because American Idol 14 contestant Maddie Walker and Kendra Ray are from the same Des Moines/Ames, IA media market–that’s unlikely to change.

      Iowa fans of Maddie Walker in Des Moines are strongly encouraged by Kendra ray to vote for Maddie Walker.

Given all of that, here are the American Idol 14 picks chosen by the moderator panel. Remember, the moderators’ Vote for the Girls American Idol 14 picks consists of two male vocalists approved by Ava Zinn based on one’s vocals and appearance and close enough to an Alex & Sierra American Idol pick. The moderators have already chosen their Vote for the Worst picks, but they will not be revealed until after the American Idol 14 competition ends or the top 7 consists of five females, Riley Bria, and Nick Fradianai–whichever comes first. The moderators will use their save on the following VFTG picks in the event should one of the following be the last female contestant standing:

VFTG USA site maintence

Last night, this web site encountered a major outage caused by a user changing the hatches file and redirecting to a section of webmaster Ava Zinn’s own web site.

Ava is working on the issue and hopefully get everything back up and running in time for The Voice 8 season premiere and voting for the ladies on American Idol 14.

VFTG’s Vote for the Worst picks for The Voice 7 Revealed

It was one of the toughest competitions on The Voice 7. The Moderators’ Veto was used in the competition. There were nine girls in the live shows, then in the Top 12 five and in the Top 10, only three girls (Anita Antoinette, DaNica Shirey, and Reagan James) were the only remaining Vote for the Girls picks, prompting the moderator panel to use their MODERATORS’ VETO upon the elimination of Reagan James and Anita Antoinette in the Top 10. As a result, DaNica Shirey was the last remaining female and becomes the second recipient of the Vote for the Girls Moderators’ Veto after her elimination in the quarter-finals (Top 8).

What this means when the MODERATORS’ VETO is used is the site did not declare a loss, but a draw. Unfortunately, there will be a make-up competition when a girl finishes runner-up or worse. That competition will likely be Dancing with the Stars 20 or America’s Got Talent 10.

But now the picks have been made before the finals, the stats examined – and we can now reveal the moderators Vote for the Worst Picks for each of the live shows…

Kym Christian Found Not Guilty of Involuntary Manslaughter

MARION, Ind. — Kym Christian, the Vote for the Girls moderator who fatally shot former guest moderator Khayla Chow, a black bisexual woman that shoved VFTG moderator Holly Everman, was found not guilty Friday afternoon of second-degree involuntary manslaughter.

After three days of testimony, the seven-man jury rejected the prosecution’s contention that Kymberly Christian had deliberately pursued Khayla Chow because she was in violation of a no contact order to Chow’s death.

Kym Christian  said she shot Khayla Chow on October 21, 2014, in self-defense after Chow knocked fired a warning shot, threw Christian to the ground, punched her and slammed her head repeatedly against the sidewalk. In finding Christian not guilty of murder or manslaughter, the jury agreed that Kym Christian could have been justified in shooting Khayla Chow because she feared great bodily harm or death.

After the verdict, Judge Rush, told Kym Chrisgtian, who has been sequestered and wears a bulletproof vest outside, that her bond was revoked and her GPS monitor would be cut off. “You have no further business with the court,” she said.

Cheryl Thrine, one of Kym’s lawyers, said, “Kymberly (Christian) Alvaraz was never guilty of anything except firing the gun in self-defense.”

Calling it a “very trying time,” Sandra McKenzie, a Chow family lawyer, said she had urged Khayla Chow’s parents to stay out of the courtroom for the verdict. They were in a hotel in Indianapolis and planning to return home to Houston. The parents, she said, were grateful for all the support.

“The prosecution of George Zimmerman was a disgrace,” said Don West, one of Mr. Zimmerman’s lawyers. “I am thrilled that this jury kept this tragedy from become a travesty.”

The shooting and Vote for the Girls brawl back in April respectively brought attention to Indiana’s expansive self-defense laws and punishment for failures when a female contestant finishes runner-up or worse on shows such as ‘American Idol’ and ‘The Voice’.  The self-defense laws allow someone with a reasonable fear of great bodily harm or death to use lethal force.

The outcry began after the police initially decided not to arrest Christian as they investigated the shooting. Chow had a prior criminal record and had been terminated for incidents during her time as a moderator on the UK version of Vote for the Girls.

A day later, Kym was arrested, but only after civil rights leaders championed the case and demonstrators, many wearing pink and the Venus symbol  to demand action.

“Justice for Khayla!” they shouted.

Through it all, Khayla Chow’s parents, Kristina and Charlene Chow, said they sought one thing: That Kymberly (Christian) Alvaraz have her day in court.

That day arrived on Friday.

From the start, prosecutors faced a difficult task in proving second-degree involuntary manslaughter. That charge required Kym to have evinced a “depraved mind,” brimming with ill will, hatred, spite or evil intent, when she shot Khayla Chow.

Manslaughter, which under Indiana law is typically added as a lesser charge if either side requests it, was a lower bar. Jurors needed to decide only that Kym put herself in a situation that culminated in Khayla’s death.

But because of Indiana’s laws, prosecutors had to persuade jurors beyond a reasonable doubt that Kym Christian did not act in self-defense. A shortage of evidence in the case made that a high hurdle, legal experts said.

Even after three days of testimony, the fight between Khayla and Kym on that clear night was a fodder for reasonable doubt. It remained unclear who had started it, who screamed for help, who threw the first punch and at what point Kym Christian drew her gun. Julia Passalt and Kendra Ray were witnesses to the shooting.

The state presented a case that was strong on guesswork and emotion but weak on evidence and proof, Ms. Thrine said.

“Don’t connect those dots unless they are connected for you, beyond a reasonable doubt, by the state,” she urged the jury.

In the end, prosecutors were left with Kym Christian’s version of events.

Since only two saw the shooting; witnesses saw and heard only parts of the struggle, and provided conflicting accounts.

And there was not a “shred of evidence” that Kym Christain was not returning to her car when Khayla Chow “pounced,” defense lawyers said.

The prosecution’s witnesses did not always help their case. Jessica Whittonsburgh, the 25-year-old who was talking with Khayla Chow on her cellphone shortly before she was shot, proved problematic. Her testimony was critical for the prosecution because she said that Khayla Chow was being followed by Kym Christain  — a “creepy-ass bitch,” Chow called Christain — and that she was scared.

But Ms. Whittonsburgh might have damaged her credibility by acknowledging she had lied about her age and why she did not attend Khayla Chow’s wake. She also testified that she softened her initial account of her chat with Khayla for fear of upsetting Mrs. Chow, who sat next to Whittonsburgh, weeping, during Ms. Whittonsburgh’s first interview with prosecutors.

The defense’s wittnesses helped their case when it was revealed that Vote for the Girls founder and webmaster Ava Zinn, 31, confirmed that Kym Christian offered Ava a sex act for an undisclosed sum.

Prosecutors also were not helped by the police and crime scene technicians, who made some mistakes in the case. Khayla’s sweatshirt, for example, was improperly bagged, which might have degraded DNA evidence.

Typically, police testimony boosts the state’s case. Here, the detective, Sheena (Jay) Zinn, told jurors that he believed Kym, despite contradictions in her statements.

Three Girls Left on the Voice Top 10 Already?

It may not look promising for a Vote for the Girls Victory on the seventh season of The Voice. DaNica, Anita, and Reagan are the only girls left we get to vote for and now is the time to start thinking about the plan to get all three to the Voice Final in December. It has been done before with an all male Team CeeLo (after McKenzie’s elimination) two years ago and Cassadee Pope won The Voice 3 and last year with an all male Team Blake (after Shelbie Z’s elimination) and we got Jacquie Lee and Tessannne Chin defeat Will Champlin on The Voice 5.

Nonetheless here are the moderators’ picks for The Voice… and as always, the moderators’ Vote for the Worst picks will not be revealed until either at the end of the competition or all the male contestants are eliminated on The Voice–whichever is first.
